A reminder that the Sunland Division 17 Owners Association Annual Member Meeting will be Wednesday, September 11, 2024. It will be held at the Sunland Golf and Country Club Ballroom, 109 Hilltop Drive, between 2:30 p.m. and 4:30 p.m. Sign-in begins at 2 p.m.

​Two things of special note about the July Board agenda:

  • ​There will be a Question and Answer period about the revision of the CC&Rs. Approval of the revised CC&Rs will be on the ballot for the September Annual Member Meeting, and the Question and Answer session will give all owners an opportunity to find out what changes are proposed, and why.
  • There will be an opportunity to nominate, from the floor, members for the Sunland North Board. Nominated candidates will also be on the ballot for the September Annual Member Meeting.

Sunland North July 2024 Newsletter

The July 2024 newsletter is now available on the website. Kathy Gross did her usual outstanding job.

Among other things, you will find information on a proposed restatement of the Sunland Division 17 Covenants, Conditions, and Restrictions (CC&Rs), which is the foundation of our homeowners association. It is important that all Sunland North members review this revision, and be prepared to vote on it for our Annual Member Meeting in September.

Proposed Amendment 4 of SunLand Division 17 Covenants, Conditions, and Restrictions

This September, members of Sunland Division 17 will be asked to vote on amending the Association Covenants, Conditions, and Restrictions (CC&Rs). Over the past year your Board, with input from legal counsel and a small working group, studied the CC&Rs, looking for ways they can be streamlined. The goal of this revision is to update and clarify the language without changing the conditions. The revised CC&Rs require Owner approval before they can be adopted.

The current CC&Rs still have references to setting up the association and to the original developer, which are no longer required, plus several grammatical and numbering errors. These outdated references and typos make the CC&Rs difficult to read and interpret.

The current CC&Rs come to 27 pages and 12,292 words. The draft amendment comes to just slightly more than 20 pages and 10,030 words.

What has been changed

  • All references to the developer have been removed.
  • Updated to conform to Washington State law as of 2024, and to incorporate some new provisions coming into effect in the near future.
  • A new section on Reserve Studies was added (required by law; content currently included in Bylaws).
  • References to things that would be done at some future date (but were completed years ago) were removed.
  • Wherever possible, the language was revised to make it more readable.

Why this is important

The Covenants, Conditions, and Restrictions are essentially an extension of your deed. They outline the obligations of the Sunland Division 17 Owners Association to the individual owners, and the obligations of the individual owners to the Association. They establish the foundation that allows the Association to purchase insurance for the Association as a whole, and help the Association to ensure that standards are met in terms of architectural design, landscaping, and maintenance, and other items that help protect your investment and make Sunland North a pleasant community.

Please study the draft amendment and prepare to vote on it, in its final form, at the September, 2024 annual meeting ballot. You can find the draft here:

Notice of Amendments to Bylaws and Rules and Regulations

In December, Sunland Division 17 was required to change its accounting service after our bookkeeper gave notice that they were getting out of the business of providing services to homeowners associations. This forced Sunland North to seek out a new accounting service immediately. It also required the Board, at the January meeting, to make two amendments to Bylaws. One additional, unrelated amendment was made to the Rules and Regulations.

Sunland Division 17 has the same process for amendment of Bylaws and of Rules and Regulations. In either case, the Board of Directors, at a regular Board meeting, proposes and votes on an amendment. The proposed amendment is then submitted to the membership (owners) for review, and at the next regular Board meeting, the membership can make comments and ask questions about the proposed amendment before the Board votes on ratification of the amendment.

As our former bookkeeper’s office address was also our registered office address, this required a Bylaws amendment:

Our former bookkeeper also co-signed checks. Our current CPA does not recommend this practice, so the Bylaws were amended to require two Board signatures:

Amendment to Bylaws, Article VII, Section 4, Financial Management. In the past, this read as “Withdrawal of monies from the accounts shall be only by checks co-signed by both the Association accountant and the Association President or Treasurer, or a person officially authorized by the Board.” The amendment reads, “Withdrawal of monies from the accounts shall be only by checks co-signed by two Board members, one of whom must be the Association President or Treasurer.” (Change is noted in red on our website): https://sunlandnorthownersassociation.com/governing-documents/sunland-division-17-bylaws/

Finally, our Rules and Regulations were amended to show a corporate email address for general submissions to the Sunland North Board of Directors:
